IMPORTANT TITLE IX INFORMATION UPDATES
October 2007
New! Effective January 1, 2005, California Law AB 1825 mandates a minimum of 2-hours of Sexual Harassment Prevention education for UC Berkeley supervisors and academic appointees every two years. The initial compliance period ended December 31, 2005. We are now in a "re-training year" and all of those who satisfied their requirement during the initial compliance period will need to take a 2-hour course again by December 31, 2007.
The law also stipulates that supervisors who are newly hired or promoted receive training and education within six months of assuming a supervisory position.
A "supervisor," as defined by the President of the University, includes all employees who supervise in administrative and academic units. The definition also includes all faculty and lecturers because of the authority such positions hold over students. Because faculty assign and direct the work of others, including research and teaching assistants, the University has determined that all faculty are supervisors.
Three options will be available to satisfy this two-hour requirement:
- Faculty and other supervisors may take the revised two-hour online education program that will be rolled our in late September 2007 by the University of California Office of the President. For those who must complete the assignment by December 31, 2007, an e-mail will be sent from Judy Boyette, Associate Vice President, Human Resources and Benefits, with a personalized link to the online education course. If you have any questions about the Sexual Harassment Prevention Course, please contact uctraining@ucop.edu. Thank you.
- Chairs and managers may invite Compliance Education Manager, Maria Lucero Padilla to their units to facilitate a tailored 2-hour workshop for faculty, graduate students and other supervisors. These can also be divided into two one-hour sessions. Those interested in this option may call Maria at 643-9707, or e-mail complianceeducation@berkeley.edu.
- Faculty and other supervisors may also satisfy the requirement be attending an instructor-led workshop. Office for the Prevention of Harassment and Discrimination currently has workshops scheduled monthly through the Interactive Course Enrollment system (ICE). Employees can register for Sexual Harassment Prevention for supervisors/faculty by entering course code 1226 at http://hrweb.berkeley.edu/ice/home/. Presentations are held in 150 California Hall.
